Terms of Service
Introduction & Acceptance
These Terms of Service ("Terms") govern your access to and use of JLA Construction’s services, including but not limited to roofing, siding, gutter services, consultations, estimates, and installations (collectively, the "Services"). By requesting or using our Services, you agree to be bound by these Terms. If you do not agree, please discontinue using our Services.
Scope of Services
JLA Construction offers professional roofing, siding, and gutter services for residential and commercial properties. Detailed descriptions of Services provided will be specified in written proposals, contracts, or confirmations.
Quotations & Acceptance
Any quote or estimate provided constitutes an invitation to contract. A binding agreement is formed only when JLA Construction issues a written confirmation or the Services commence, whichever occurs first.
Pricing & Payment Terms
- Prices are as stated in the written proposal. Unless otherwise specified, prices exclude taxes, permits, shipping, and other applicable charges.
- For Service contracts longer than (e.g., 45 days), payment shall be made in installments matching completed milestones. Final payment is due within 30 days of invoice.
- Late payments may incur interest (e.g., 1.5% monthly or 18% annually) after a grace period of 30–60 days.
- JLA reserves the right to suspend or delay Services if payment is late.
Change Orders
Any requested changes to the scope of Services (scope, schedule, materials) must be documented in writing, and revised pricing will apply.
Customer Responsibilities
You agree to:
- Provide safe access, permits, and necessary site conditions.
- Ensure utilities are operational where required.
- Notify JLA in advance of any structural hazards or materials of concern (e.g., asbestos).
Warranties & Limitations of Liability
- JLA warrants Services performed with reasonable skill and care. Any defects must be reported within a specified period (e.g., 30 days) to be addressed.
- Liability is limited to:
- Reforming defective work, or
- Refunding the amount paid for the defective portion.
- JLA is not liable for indirect or consequential losses, loss of profit, or third-party claims.
Force Majeure
JLA is not liable for delays or failures due to circumstances beyond its control—such as weather, labor disputes, material shortages, or governmental actions.
Confidentiality
Both parties shall keep confidential any non-public, business-sensitive information exchanged during the term of the contract.
Termination
Either party may terminate the agreement upon written notice if the other party materially breaches the Terms and fails to remedy it within a reasonable time. Upon termination, you must pay for all Services performed up to the termination date.
Governing Law & Dispute Resolution
These Terms are governed by the laws of [state/jurisdiction, e.g., Washington State]. Any dispute shall be resolved via [negotiation, mediation, or binding arbitration] before pursuing litigation.
Amendments
JLA may update Terms from time to time. Updated versions will be posted on our website or communicated directly. Continued use constitutes acceptance of those changes.
